These Terms define the conditions under which users may browse hikon.app and register on the waitlist for the future Hikon service.

Hikon is a training-tracking and coach-athlete companion application project. As of the publication date of these Terms, the service is not yet open to the public: no payment is requested and no service is rendered.

Registering on the waitlist implies full and unreserved acceptance of these Terms and of the Privacy Policy. If you do not accept these conditions, please do not register on the waitlist.

Registration is open to individuals aged 16 and over. It is carried out via the dedicated form, by providing a valid email address and, optionally, your role (coach or athlete) and preferred language.

• only one registration per email address is accepted
• automated, fraudulent, or multiple registrations are prohibited and will be deleted
• the order of registration does not constitute a right of priority access to the service
• the publisher reserves the right to refuse or delete any registration contrary to these Terms

As of the publication date of these Terms, Hikon is not a paid service. No service contract, subscription, or financial transaction arises from your registration on the waitlist. The conditions of service provision, prices, subscription terms, and any right of withdrawal will be covered by an update to these Terms before the service actually opens.

Hikon is designed as a tool for tracking and helping plan training. It does not in any way constitute medical advice, a diagnosis, treatment, or a prescription.

Before resuming or significantly changing your physical activity, you are advised to consult a qualified health professional (physician, physiotherapist, certified sports coach).

The publisher disclaims all liability in the event of injury, health disorder, overtraining, or damage resulting from inappropriate use of the content presented on the site or in the future application.

The name "Hikon", the logo, the visual identity, texts, images, videos, graphics, interfaces, and code elements present on the site are the exclusive property of Alexandre Botta or the subject of a duly acquired license.

Any reproduction, representation, extraction, modification, publication, or commercial exploitation, in whole or in part, without prior written authorization from the publisher, is strictly prohibited and constitutes infringement punishable under Swiss law and, where applicable, under applicable international conventions.

To the fullest extent permitted by law, the publisher shall not be held liable for:

• temporary or permanent unavailability of the site, including for maintenance
• the inability of a user to register on the waitlist
• any indirect, intangible, or financial loss resulting from use of the site
• use of the information disseminated for purposes not in accordance with these Terms

The site is provided "as is". The publisher strives to ensure its availability and security but cannot guarantee the absence of errors, bugs, or vulnerabilities.

The processing of personal data collected as part of your waitlist registration is detailed in the Privacy Policy, accessible at /privacy. We invite you to read it before any registration.

You may request at any time to be removed from the waitlist by writing to [email protected]. Your request will be processed within a maximum of 30 days and your data will be deleted in accordance with the Privacy Policy.

The publisher reserves the right to modify these Terms at any time, in particular to reflect changes in the service or in legal or technical requirements. The version applicable is the one published on the site at the time of your access. Any material change will be notified by email to waitlist registrants.

These Terms are governed by Swiss law, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods.

Any dispute relating to their interpretation, performance, or validity shall fall within the exclusive jurisdiction of the ordinary courts of the publisher's place of domicile, subject to the mandatory consumer-protection provisions that may grant jurisdiction to the courts of the user's domicile.
